Terms of use
These terms are the agreement between you and Sparksbud ("we", "us") for using sparksbud.com (the "site"). By using the site you agree to them. If you do not agree, please do not use the site.
1. What the site is
Sparksbud offers interactive visual worlds with music, free of charge, for relaxation and enjoyment. We may add, change, pause or remove any world or feature at any time without notice.
2. Health and safety
Please read this section before using the site, especially in a headset.
- Light sensitivity. Some worlds contain bright, fast-moving or changing light and patterns. A small number of people can have seizures or blackouts triggered by such images, even with no history of epilepsy. If you or anyone in your family has had seizures or epilepsy, talk to a doctor before using the site. Stop at once if you feel dizzy, see differently, have eye or muscle twitches, or feel disoriented.
- Motion. Moving imagery can cause discomfort, dizziness or nausea, particularly in virtual reality. You can slow or pause motion in the settings. Take regular breaks, and stop if you feel unwell.
- Virtual reality. Follow your headset maker's health and safety guidance, including its age guidance for children. Use a clear space, stay seated if you are unsure of your balance, and remember that you cannot see the room around you.
- Attention. Do not use the site while driving, operating machinery, or doing anything else that needs your attention.
The site is for enjoyment only. It is not a medical, therapeutic or wellness treatment, and nothing on it is health advice.
3. Using the site fairly
You may use the site for your own personal, non-commercial enjoyment. Please do not:
- use the site in a way that breaks the law or harms anyone;
- attack, overload, probe or interfere with the site or the systems it runs on;
- copy, download in bulk, resell or redistribute the worlds, music, images or code, or present them as your own;
- use automated tools to collect the site's content, other than ordinary search engine indexing.
You are welcome to share links to the site and to any world, and to share screenshots and short clips for non-commercial purposes with credit to Sparksbud. For anything else, including public display, events or commercial use, please ask first at [email protected].
4. Who owns what
The worlds, visual designs, music, recordings, text, names and logo on the site belong to Sparksbud or its licensors and are protected by copyright and other laws. These terms give you permission to view and enjoy them on the site, and nothing more. Open source software and fonts used by the site remain under their own licences.
5. No accounts, and your privacy
The site needs no account or personal details to browse. If you choose to send a note, we receive the name, email and message you provide. The privacy policy explains how this and other visit information are handled.
6. Other services
The site may link to, or load files from, services run by others, such as the network that delivers the music. We are not responsible for services we do not control.
7. No warranty
The site is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error free, secure, or suitable for any particular purpose or device, and we disclaim all implied warranties.
8. Limit of liability
To the fullest extent the law allows, Sparksbud will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, arising from your use of the site or your inability to use it. Because the site is free, our total liability for any claim relating to it is limited to fifty US dollars. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law where you live.
9. Changes to these terms
We may update these terms from time to time. The date at the top shows the latest version. If you keep using the site after a change, you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules, except where the law of the place you live gives you rights that cannot be set aside.
